1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Microsite Generator website and services (the "Service"), operated by 1000x Digital LLC ("1000x Digital," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Microsite Generator is a software platform that helps users build compliant, multi-page microsites on domains they own or control. The Service is designed to support content that adheres to Google Search Essentials and applicable search-engine guidelines. We provide tools; you remain responsible for the domains you connect, the content you publish, and your compliance with all applicable laws and third-party policies.

3. Acceptable use

You agree not to use the Service to create or distribute content that is unlawful, infringing, deceptive, or that violates the published policies of search engines or other platforms. Prohibited uses include, without limitation: building doorway pages, engaging in scaled content abuse, cloaking, deploying deceptive redirects, publishing malware or deceptive content, infringing intellectual property, or any activity that violates Google's spam policies or Search Essentials. We reserve the right to suspend or terminate access for any use that we reasonably believe violates these Terms or creates risk for the Service or other users.

4. Your content and domains

You retain ownership of the domains you connect and the content you create. You represent and warrant that you have the rights necessary to use those domains and to publish your content, and that your use does not infringe the rights of any third party. You are solely responsible for the legality and accuracy of content you publish through the Service.

5. Compliance and no guarantee of rankings

While the Service is engineered to support compliance with Google Search Essentials, search-engine rankings depend on factors outside our control, including search-engine algorithms that change without notice. We do not guarantee any specific ranking, traffic, indexing, or business result. Nothing in the Service constitutes a guarantee that a given page will rank, be indexed, or avoid a penalty, particularly where user-supplied content or domains do not meet quality and compliance standards.

6. Fees and subscriptions

Paid plans are billed in advance on the cycle disclosed at purchase. Unless required by law, fees are non-refundable. We may change pricing prospectively with notice. Failure to pay may result in suspension or termination of access.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by 1000x Digital and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding except as necessary to use the Service as intended.

8. Third-party services

The Service may reference or link to third-party services, including search engines and registrars. We are not responsible for third-party services or their policies. References to Google and Google Search Essentials are for informational and compliance purposes and do not imply endorsement, partnership, or affiliation with Google.

Accessibility

1000x Digital LLC is committed to digital accessibility and builds Microsite Generator and its generated microsites to align with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA, including semantic structure, keyboard navigation, descriptive alternative text, and sufficient color contrast. Accessibility is an ongoing effort and not all third-party or customer-added content can be guaranteed. If you encounter an accessibility barrier, contact us and we will work to address it.

Publisher responsibility

Microsite Generator is a software tool that helps you create and publish microsites on domains you own and control. You are the publisher and operator of any microsite you create. You are solely responsible for the content you add, the truthfulness of your claims, and your microsite's compliance with applicable laws — including accessibility (ADA/WCAG), advertising, privacy, and industry-specific regulations. Microsite Generator provides technically sound, accessibility-aware structure built to Google Search Essentials and WCAG 2.2 AA basics, but does not guarantee the legal compliance of your published content and is not the publisher of your microsites. You agree to use the Service lawfully and to keep your microsites accurate and current.

Data: controller and processor

For leads and visitor data captured through your microsites, you are the data controller and Microsite Generator acts as a data processor on your behalf. You are responsible for providing your visitors with an appropriate privacy notice and for honoring their privacy rights under applicable state and federal law. A Data Processing Agreement is available on request.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, 1000x Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the amounts you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless 1000x Digital from any claims, damages, or expenses arising from your content, your domains, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, for legal reasons, or to protect the Service. Provisions that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and continued use after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws principles, and you consent to the exclusive jurisdiction of the courts located in Michigan for any dispute not subject to arbitration.
